Santa also uses non-competition and non-solicitation clauses

For many companies, the major value of the business comes from its experienced staff. We have, however, in many assignments noticed that the companies do not always act as if they have acknowledged the value of their staff. This asset, their own staff, is not necessarily treated in a fair way or the company does not protect the know-how of their staff from misuse of competitors.

Our client, who is in the Christmas business and employs also the Santa Claus himself, has ensured this by including non-competition and non-solicitation clauses to their Senior Management level agreements. This is a good way of trying to prevent competitors from utilizing other company assets.

We wouldn’t like to have many Santa Clauses in the world, would we? 😊
