Diligence is needed when it comes to brand licensing contracts. In other words, you have to agree what the client is permitted to do and what the client is not permitted to do. The tone of the contract is important as well – it should neither be too prohibitive nor too permissive. For example, we recently licensed a Santa Claus theme Park in China and a lot of practical challenges and cultural differences cropped up during the process. Furthermore, the opposing party was a huge organisation that has much more in the way of resources than us.
Fondia’s operation model is perfect for us. We predominantly work in Lapland and our clients have many long-term relationships with local law firms. For example, when contracting with hotel chains, we cannot use the same law firm as the contracting party. This problem has now vanished – conflict of interest is no longer an issue.
The fixed monthly fee of Fondia’s Legal Department Service is outstanding. It can be planned into the budget and the resource provision always exists in principle. This is why the threshold to use the service is lower. The service can be adapted to our busy seasons: we need more services from Fondia from November to March when we have 200 employees. Among other things, the contracts of employment usually take a lot of time to prepare.
Fondia allocates a team of experts who come at a reasonable price. We do not need to start searching for a lawyer from a specific city who has knowledge of a certain field of law. It is brilliant that with Fondia we get an expert for every legal issue that we encounter. What I have learned is that regarding the field of law, contract law experts are not the same people as those who help at settling disputes.
The service is swift and the matters are taken care of in a flexible way. This is something we appreciate a lot. On occasions, someone calls from Fondia and asks if we require their assistance. In particular, our agreements with a Chinese contracting party were taken care of in an efficient manner and outside of regular working hours. As you probably know, midday in China is early morning in Finland, so the work had to be done either late at night or very early in the morning. It was really valuable for us that Fondia was able to follow our daily rhythm.
I have had only positive experiences with Fondia and this package works amazingly well. I would guess that there are lots of firms similar to ours in Finland that could benefit from Fondia’s expertise.
